ARE YOUR EMPLOYEES TAKING TIME OFF? DO YOU KNOW WHAT YOU CAN, SHOULD OR MUST DO ABOUT IT?

California employers have lost even more flexibility in "paid time off" options with the introduction of mandatory sick leave in July of 2015. In addition to hampering business operations and company productivity, employee absences can present legal challenges for employers in determining when to permit an absence, when to bring the employee back, what leaves and benefits to offer, and how to maintain ongoing business activities without key staff members.

In this informative seminar, employment law attorney Karen L. Gabler will discuss the employer's rights, obligations and questions regarding employee absences and paid or unpaid time off. Topics covered will include the following:

  • What is an "excused" absence?
  • What information do you need (or can you get) from an employee who will be absent?
  • What information do you need (or can you get) before the employee is permitted to return?
  • What is your obligation under the 2015 mandatory sick leave rules?
  • When can you request a doctor's note in connection with an employee's illness or injury?
  • When can you talk to the employee's doctor (and when should you avoid doing so)?
  • What are the current legal requirements for PTO, vacation and sick leave policies?
  • Why is PTO no longer your best option as an employer?
  • When should worker's compensation be involved?
  • What documentation is required for employee absences and use of paid time off?
  • When can you terminate an employee for excessive absence (and when are you prohibited from doing so)?
  • What notice of absence must your employee provide to you?
  • When can you discipline an absentee employee (and when are you prohibited from doing so)?
  • When can you dock pay for absent exempt and non-exempt employees?
  • How can you effectively track employees' use of paid time off (and when are you required to do so)?
  • When can you "cash out" paid time off benefits (and when are you prohibited from doing so)?

To enable us to plan for your attendance, please rsvp at least 24 hours in advance. If you reserve a spot and then later find that you are unable to attend, please inform us in advance so that we may offer your seat to someone else.
