California's New Victim Protection Leave Notice is Here! Are You Compliant?

Calling all California employers: the wait is over! The California Civil Rights Department (“CRD”) officially released its long-awaited model notice required under the state's expanded victim protection leave law titled, “Survivors of Violence and Family Members of Victims Right to Leave and Accommodations.” You can find it here.

Businesses must now provide this notice to employees in the following situations:

  • When hiring new employees
  • Annually to all current employees
  • Upon an employee's request
  • Whenever an employee informs you that they or a family member are a victim

For purposes of this notice (and the law), “victims of violence” include victims of domestic violence, sexual assault, stalking, violent threats, acts involving the use or presence of a dangerous weapon, or any violence causing injury.

A “family member” is defined as a “child, parent, grandparent, grandchild, sibling, spouse, domestic partner, or designated person” who experiences a qualifying act of violence.

Although you can create your own form, be careful. Your notice must strictly adhere to state requirements. Best practice: use the CRD’s model notice.
