Is your worker an employee or independent contractor?

With California's burdensome employment laws and the rise of technology and the gig economy, business owners may find it desirable to classify California workers as independent contractors. Unfortunately, even inadvertent misclassification of employees can result in significant liability and penalties. Proper classification of workers is essential to the company's protection.

In this informative program, employment attorney Karen Gabler will discuss:

  • How to determine if your worker is an employee or a valid independent contractor
  • The Dynamex "ABC Test"
  • Exceptions to the test under AB 5 (2020) and related legislation (2021)
  • The Borello "production and control" test
  • Properly documenting a valid independent contractor relationship
